As if foreign nationals and employers weren't already dissuaded enough from filing H-1B petitions, H-1B denial rates overall have skyrocketed. While denial rates for initial H-1B petitions never exceeded 8% between 2010 and 2015, the denial rates for new H-1B petitions quadrupled from 6% to 24% between 2015 and 2018. Accordingly, before a prospective employer spends upward of $8,000 on an H-1B application, an extensive consultation with an immigration lawyer would be beneficial.
Immigration lawyers are keenly aware of the additional burden that USCIS has been imposing upon H-1B applicants in recent years. In fact, immigration lawyers regularly share accounts of the crazy measures that have become necessary in order to keep track of the onslaught of all of the Requests for Evidence (RFEs) that are generated in response to the filing of an H-1B application. Believe it or not, some lawyers have had to order six and seven white boards to hang in their offices for the sole purpose of tracking the RFEs for clients. If you're a foreign national contemplating filing an H-1B application, it may be better for you to consider filing a different type of application. An attorney can help to guide you with your options.
