Protecting Your Rights: A Critical Warning on Immigration Fraud & Removal Defense

At our firm, we believe that staying informed is the first line of defense. We want to sensitize foreigners (aliens) currently in removal proceedings to be extremely discerning when responding to solicitations for money. Regardless of how much legal jeopardy you believe you are in, please remember: retaining a licensed attorney remains the best way to truly protect your interests and shield yourself from fraudsters. Despite "expert" advice or random recommendations from non-lawyers on social media, sophisticated scams are on the rise. Foreigners have reported receiving letters, each claiming to be an official grant of a Writ of Habeas Corpus.

The Anatomy of a Scam: Perpetrators are using three specific tactics to steal your money and jeopardize your case:

  1. Trusted Branding: Scammers are forging letters using the logos of reputable organizations, like Catholic Charities, to get you to lower your guard.

  2. Complex Terminology: By using high-level legal terms like Habeas Corpus, they create a "veneer of authenticity" designed to confuse non-lawyers.

  3. The Financial Hook: This is the most dangerous part. These fake documents often state that a "bond payment" or "direct deposit" is required to secure a release.

The Legal Reality: A legitimate grant of Habeas Corpus is a judicial order for release, it does not require a bond payment to be executed. Furthermore, any official federal court grant would be reflected in public federal court dockets. Lawyers can easily check federal dockets to see if a corresponding court document was added to a docket.

Don't become a victim. If you or a loved one receive a document that seems too good to be true or demands immediate payment, verify it with a licensed professional. Reach out to the law firm for assistance by calling 201-875-2600.
