F-1 Students: Your LinkedIn is now an Evidence Log
We are seeing a major surge in USCIS issuing Notices of Intent to Deny (NOIDs) for F-1 EAD and OPT applications. What's fueling some NOIDs? ... A direct comparison between your SEVIS employment records and your online profiles, specifically LinkedIn. The "Unpaid Work" Trap USCIS is now aggressively claiming "unauthorized employment" for activities listed on social media that don't match your SEVIS history. Even if the work was unpaid, like "helping out" at a friend’s start-up or an informal internship, USCIS may view it as a status violation. Behind the Scenes at USCIS My office will continue to actively track these trends. While robust responses to NOIDs are encouraged, the government is taking its time to adjudicate them, resulting in a significant "adjudication freeze." Cases across the country, from October and November 2025, are still awaiting a final decision (as of March 2026). Proactive Defense If you have an EAD application pending, now is the time to audit your digital footprint. Discrepancies between your resume, LinkedIn, and SEVIS, can lead to a NOID that stalls your career for months. In this climate, "oops" is not a legal defense. Don't Navigate an NOID Alone A NOID is not an automatic denial, but it is a "last chance" warning. If you’ve received a notice or are worried about your employment history, you need a strategy backed by current data. Call my office at 201-875-2600.
