AILA Files Lawsuit to Prevent Substantial USCIS Fee Hikes

Updated: Jan 14, 2021

The American Immigration Lawyers Association has filed a lawsuit against the Department of Homeland Security seeking to enjoin the massive fee hike that is scheduled to take effect on October 2, 2020. See "Lawsuit challenging US non-immigration visa fee hike filed in US district court".

This fee hike, originally announced by DHS in the last quarter of 2019, will be prohibitively expensive for many foreign nationals. By way of example, the filing fee for U.S. Citizenship applications will increase from $725 to $1,200, while the filing fee for U.S. permanent residence applications will increase from $1,225 to $2,300.

The lawsuit will attempt to indefinitely delay this substantial fee increase on the basis that necessary procedures were not followed by the current Administration.
